Amendment of the Malaysia Agreement 1963


Malaysia Agreement was signed in London by all partners, United Kingdom of Great Britain and Northern Ireland and Federation of Malaya, North Borneo, Sarawak and Singapore bearing registration number 10760 at the United Nations. The such agreement has been amended once since then on 28th August 1963 as you can see below;


The amendment of the Malaysia Agreement 1963 was made to change the inauguration date of 'Malaysia Day' from 31th August 1963 to 16th September 1963 due to the response to the request made by the Governments of the Federation of Malaya, the Republic of Indonesia, and the Republic of the Philippines, on 5 August 1963, for the United Nations  to ascertain, prior to the establishment of the Federation of Malaysia, the wishes of the people of Sabah (North Borneo) and Sarawak. The Final Conclusion was made by the Secretary General of the United Nations on 14th September 1963. Below is the amendments made to the Malaysia Agreement 1963. This is the only amendment made to the Malaysia Agreement for the span of 53 years since 1963. 


Accordingly with such amendments, it is a fact that the Malaysia Agreement can only be changes and amended by the mutual agreement by all partners to the signatories of the Malaysia Agreement only. The Malaysia Constitution cannot changes and override the Malaysia Agreement, instead the Malaysia Constitution is subject to the compliance to the Malaysia Agreement and Inter-Governmental Committee Report. Malaysia Agreement was made and agreed between the Governments.
